In the summer of 2015, plaintiff Wendy Henriquez, a house cleaner in her 30s, reported damage to an apartment that she rented with her family at 4733 Mission St., in San Francisco. She claimed that since that time, her landlord, Sally Liu, has refused to make any repairs. Henriquez sued Liu, claiming Liu refused to remedy the complete lack of heat in the apartment and a hole in ceiling from a defective roof that caused the wood in the ceiling to rot. Henriquez’s counsel noted that for nearly two years, as of the time of trial, Liu had outstanding notices of violation from the city of San Francisco. Liu claimed that Henriquez caused the damages to the property herself and that Henriquez refused entry to allow for repairs., Henriquez, a wife and mother of three children under the age of 7, supported her family as a house cleaner. Her neighbors testified that Henriquez and her family would take refuge in their units to warm up due to the lack of heat in their own unit. They also testified that Henriquez’s children often became ill with colds that would last for long periods of time. Henriquez claimed that as a result of her experience living in the apartment, she suffered from emotional distress. She also sought recovery of the amount she spent trying to make the repairs herself.
