On March 30, 2017, claimants Ibrahim Fetahi and Jennifer Kormos were evicted from their rent-controlled tenancy/occupancy at 375 Moncada Way, in San Francisco. Fetahi and Kormos claimed that there were multiple instances of significant water intrusion at the property beginning on Aug. 1, 2015 and that when they complained about it, the property owners retaliated against them by evicting them. Fetahi and Kormos brought a claim against the property owners, Mark and Penny Thamkul, alleging habitability violations. Fetahi and Kormos claimed that the rental property had multiple instances of significant water intrusion, including sewer backups, and an overflowing toilet and shower, causing sewage to spill into the flooring. They claimed that, when they complained and requested repairs and a reduction in rent, they were evicted. The Thamkuls disputed the claimants’ allegations, claiming that all of the water damage was to the lowest level of the residence, which was not occupied by the claimants at any time. The Thamkuls also claimed that they were responsive and compliant in regards to all of the claimants’ requests and that the claimants were evicted for legitimate reasons., Fetahi and Kormos sought recovery for the loss of their rent-controlled housing. They also sought recovery of moving expenses and damages for their respective emotional distress.
