FACTS
On Sept. 20, 2010, plaintiff Rosetta Kindred, a retired 73-year-old, was driving on Wilshire Boulevard in the Wilshire Corridor of Los Angeles. When she was near the intersection with Westholme Avenue, she was sideswiped by a truck driven by Anthony Elvin. Kindred claimed to her back as a result of the collision. Kindred sued Elvin and the owner of Elvin’s vehicle, JCA Trucking Inc. She alleged that Elvin was negligent in the operation of his vehicle and that JCA Trucking was vicariously liable for his actions. Elvin claimed that the accident was Kindred’s fault, in that the plainiff was the one who sideswiped him., After the accident, Kindred was taken to UCLA Medical Center, where she was examined by doctors. Kindred claimed the accident caused soft-tissue to her back. She subsequently underwent a period of physical therapy. Kindred claimed she suffers no residual pain and is not undergoing any further medical treatment. Thus, she sought recovery for her medical expenses and past pain and suffering. Defense counsel asserted that Kindred’s were all exaggerated and that she could not have been injured in the manner she claimed.
