FACTS
At around 5:15 a.m. on July 22, 2014, plaintiffs’ decedent Sean Mescher, 49, a fuel distribution system worker at Lemoore NAS, was commuting to work on a 2007 Harley Davidson motorcycle. Mescher was westbound on Grangeville Boulevard, in Hanford, an unincorporated area of Kings County, and he was wearing a Department-of-Transportation-approved helmet with his headlight illuminated. As he entered the intersection with 16th Avenue, a 2009 Chevrolet Silverado pickup truck, operated by Jaime Vargas, attempted a left turn from eastbound Grangeville Boulevard onto northbound 16th Avenue, turning in the direct path of Mescher. As a result, Mescher was unable to avoid the collision and sustained multiple traumatic . He subsequently died at the scene. The decedent’s wifeRebecca Mescher, and his two adult daughters, Naomi Mescher and Rachel Mescher, sued Vargas and Vargas’ employer, Terra Linda Farms, the registered owner of the truck. The decedent’s family alleged that Vargas was negligent in the operation of the truck and that Terra Linda Farms was vicariously liable for Vargas’ actions. The decedent’s adult stepchildren — Alisha Arambula, Robert Sandoval, Jessie Romero, and Andrew Romero — were also initially named as plaintiffs, but they were ultimately dismissed from the case. Vargas admitted liability., Mescher sustained multiple traumatic , including blunt force trauma, and died at the scene. He was 49 years old. He was survived by his wife, Rebecca Mescher, then a 61-year-old medical assistant; two adult daughters, Naomi and Rachel Mescher, then both 26-year-old students; and four adult stepchildren (who were not part of the lawsuit), Alisha Arambula, Robert Sandoval, Jessie Romero, and Andrew Romero. The decedent’s wife and two adult daughters sought recovery of wrongful death damages.
