FACTS
On Aug. 22, 2018, claimant Joel Knight, 66, a financial business owner, was driving on Canyon Del Rey, in Seaside. As he entered the intersection with Del Monte Boulevard, his vehicle was broadsided on the passenger side by a vehicle operated by Bravlio Diaz, who entered the intersection from Del Monte Boulevard. Knight sustained to his right wrist and shoulder. In lieu of filing a lawsuit, Knight sought recovery directly from Diaz’s insurer, IDS Property Casualty Insurance Co. Knight also sought further recovery via the supplementary-underinsured-motorist provision of his own insurance policy, which was administered by Liberty Mutual Insurance Co. Knight claimed that Diaz ran a red light at the intersection, causing the collision., Knight sustained a distal radius fracture fracture of the right, dominant wrist, including a fracture of the coronal plane and a displaced, intra-articular fracture with a volar fracture fragment. He also sustained contusions to his right, dominant shoulder and arm. Knight was taken to a hospital, and he ultimately underwent open reduction and internal fixation surgery on his right wrist. Knight claimed that he still suffers pain and that he has a decreased range of motion in his right wrist. He also claimed that he has a deformity on his right wrist. Knight alleged that as a result, he will need future physical therapy as well as diagnostic tests and office visits. He also alleged that he will eventually require surgery to remove the hardware in his right wrist. Knight sought recovery of approximately $8,600 in past, adjusted medical costs. He also sought recovery of future medical costs, and damages for his past and future pain and suffering.
