On April 20, 2018, plaintiff Margaret Hardgrave fell while she was traversing a sidewalk that abutted the premises of 1951 Ocean Ave., in San Francisco. Hardgrave sustained of her head and a wrist. Hardgrave sued the adjoining premises’ owner, Ramallah Club Inc., and the sidewalk’s owner and maintainer, the city and county of San Francisco. Hardgrave alleged that the defendants failed to timely repair and/or maintain the sidewalk, creating a dangerous condition. Ramallah Club was ultimately dismissed from the case. Plaintiff’s counsel contended that tree roots caused an uplift in the sidewalk, causing Hardgrave to trip and fall. Counsel contended the city and county of San Francisco should have known about the dangerous condition, but failed to timely repair the condition and appropriately maintain the sidewalk. Counsel for the city and county of San Francisco asserted that the alleged defect was open and obvious., Hardgrave sustained a closed head injury and a wrist fracture. She was taken to a hospital, where she was treated and released. She claimed that she would require further medical care. Hardgrave sought recovery of $25,000 in past medical costs and an unspecified amount in future medical costs. She also sought recovery of damages for her past and future pain and suffering.
