FACTS
On Dec. 5, 2019, claimant Jane Fulton, a 66-year-old unemployed woman, was attacked by a pit bull. The incident occurred in the backyard of her residence, in Fresno. The dog’s owner, Thomas Glaski, had left the animal at the residence, to be supervised by the residence’s owner, Lolita Linscheid. Fulton suffered of an ankle and a leg. In lieu of filing a lawsuit, Fulton sought direct recovery from Glaski’s insurer, Safeco Insurance Cos., and Linscheid’s insurer, American Automobile Association. Fulton alleged that Glaski and Linscheid negligently failed to properly control the dog. The insurers conceded liability. The matter proceeded to damages., Fulton suffered bite wounds of her left ankle and her left calf. Fulton was transported to a hospital, where she underwent debridement of damaged tissue. She subsequently developed a Methicillin-resistant Staphylococcus aureus bacteria infection. She underwent about five months of inpatient rehabilitative treatment. She also underwent occupational therapy and physical therapy. Fulton claimed that she has developed post-traumatic stress disorder. She also claimed that the bite aggravated a preexisting, previously asymptomatic neuropathic condition. She claimed that her left ankle and her left calf resultantly experience numbness, paresthesia and weakness. She further claimed that her residual effects hinder her ambulation. She retains scars of her left ankle and her left calf. A plastic surgeon has opined that surgery may improve the scars’ appearance. Fulton’s sought recovery of about $65,000 for past medical expenses, an unspecified amount for future medical expenses, and damages for past and future pain and suffering.
