In 2012, claimants consisting of five seasonal workers of Filipino national origin who worked for Sunridge Nurseries Inc., a grapevine nursery in Bakersfield, began to believe that Filipino employees were being treated differently from non-Filipino workers. The workers all verbally complained to supervisors multiple times about the alleged racial discrimination. The claimed that after they made their complaints, they were retaliated against and that the discrimination and retaliation continued until 2014.
The five workers filed complaints with the U.S. Equal Employment Opportunity Commission, which first attempted to reach a pre-litigation settlement through its conciliation process.
The EEOC sued Sunridge Nurseries Inc., alleging violations of Title VII of the Civil Rights Act of 1964.
The EEOC claimed that Sunridge Nurseries treated Filipino and non-Filipino workers differently in that there were differences in payments, assignments and even working conditions.
The five workers claimed that they were employed during the vine stock harvesting season and that the company would usually contact one or more of them every year, at the start of a season, to re-hire all five of them for seasonal employment. However, they claimed that after their complaints, they were still rehired, but they were given the worst rows in the nursery, were the first workers dismissed, were not recalled to work after stoppages and were given lower-paying assignments than workers who were not Filipino. They also claimed that this discrimination continued from 2012 until 2014.
Representatives of Sunridge Nurseries denied all of the workers’ and EEOC’s claims., The five seasonal workers sought recovery of lost wages as a result of the alleged difference in pay. They also claimed that they suffered from emotional distress as a result of the incidents and sought recovery for their emotional pain and suffering.
